ED Delays Third-Party Servicer Guidance

- Last week the U.S. Department of Education (ED) announced that it was delaying and revising its February 2023 Third-Party Servicer guidance following immense pushback from the higher education community, including AACOM’s joint letter with AAMC.
- In its announcement, ED clarified that clinical opportunities that meet requirements under existing regulations will not need to register as third-party servicers.
- ED is continuing to review stakeholder comments and intends to release revised guidance later this year. Any such guidance will not go into effect until six months after announcement in order to provide institutions of higher education sufficient time to comply.
